These General Terms and Conditions of Sale (hereinafter referred to as “Terms”) govern all transactions made on the e-commerce website www.theallamericanshades.com (hereinafter referred to as “the Site”). They specify the rights and obligations of the parties in the context of the sale of products and services offered by The All American Shades managed by Serus Distribution, whose registered office is located in Carvin, France, and registered with the Arras Trade and Companies Register under number 499 790 525.

Acceptance of these Terms implies full and unconditional acceptance by the buyer (hereinafter referred to as “the Client”).

1. Purpose

These Terms define the conditions under which The All American Shades sells its products to its clients via the Site. They apply to the exclusion of any other document or condition.

2. Products

The products available for sale are those presented on the Site. Each product is described and presented as accurately as possible. However, slight variations may exist between the photographs and the actual products.

The products are offered subject to stock availability. In the event a product is unavailable after an order is placed, we will inform the Client and offer either a refund or an equivalent product.

3. Prices

The prices of the products are indicated in euros, including all taxes (VAT), excluding delivery charges, which are specified at the time of ordering. The All American Shades reserves the right to modify its prices at any time, but the price charged will be the one in effect at the time of order confirmation.

Delivery charges vary depending on the destination, weight, and chosen delivery method.

4. Orders

The Client places an order via the Site by following these steps:

  1. Select products and add them to the cart;
  2. Validate the cart;
  3. Create or log in to a user account;
  4. Enter delivery and billing details;
  5. Validate the order and accept the Terms;
  6. Secure payment using the available methods.

The order is confirmed by sending a summary email to the address provided by the Client. The All American Shades reserves the right to refuse or cancel any order in case of a dispute with the Client or non-payment.

5. Payment

Payment for products is made when placing the order, by credit card, PayPal, or any other secure payment method offered on the Site.

Transactions are secured through encryption technology (SSL). The All American Shades never has access to the Client’s confidential payment information.

In case of non-payment, The All American Shades reserves the right to suspend or cancel the order.

6. Delivery

Products are delivered to the address specified by the Client when placing the order. Delivery times are provided as an estimate and vary depending on the destination and chosen delivery method. The All American Shades cannot be held responsible for delays or failure to deliver due to external factors (strike, transport disruptions, etc.).

If delivery is delayed by more than 14 working days beyond the announced date, the Client has the right to request the cancellation of the order and a refund of the amounts paid.

The risk of loss or damage to the products is transferred to the Client upon delivery.

7. Right of Withdrawal

In accordance with Article L221-18 of the French Consumer Code, the Client has a 14-day period from the receipt of their order to exercise their right of withdrawal without having to provide any reason.

To exercise this right, the Client must notify The All American Shades of their decision to withdraw (for an exchange or refund), either by email at contact@theallamericanshades.com or via the contact form available on the Site.

The returned item(s) must be new, unused, and in their original packaging in perfect condition. The product must not have been worn, meaning its use should not exceed the time necessary for trying it on.

The Client can make only one refund or exchange request per order.

Returned products must be properly packaged to prevent damage during transport. The Client must retain the receipt of the parcel issued by the postal service. In case of loss of the parcel, no refund or exchange can be made without this receipt.

The Client has 14 days from the date of the withdrawal request to return the merchandise. No request will be accepted after this period.

In case of withdrawal from this contract, we will refund all payments received from you, including delivery charges (except for additional costs arising if you selected a delivery method other than the standard, lower-cost delivery method offered by us).

Upon receipt of the package, The All American Shades will assess the condition of the returned merchandise. No return will be accepted if the returned items have been visibly used or damaged by the Client, and if such use or damage renders the items unfit for sale.

If the return is refused by The All American Shades, the items will be returned to the Client at the expense of The All American Shades, without the Client being able to claim any compensation or refund, except for the subsequent exercise of their rights under the warranty for sold goods.

In the case of an exchange, if the returned items have been visibly used or damaged by the Client, and such use or damage renders them unfit for sale, The All American Shades may pursue recovery actions against the Client.

We reserve the right to refuse a return if it is damaged, if one or more elements are missing, or for hygiene reasons.

The refund will be made within 14 days of receiving the returned product.

8. Warranty and Liability

Products are covered by legal warranties of conformity (Articles L217-4 to L217-14 of the French Consumer Code). The warranties apply for a period of 2 years against manufacturing defects but do not cover normal wear and tear, including scratches on the lenses, damage, or breakage resulting from use or improper handling.

The All American Shades is only responsible for the content present on the Site. It cannot be held responsible for damages resulting from the use of the Internet (virus, data loss, etc.).

9. Personal Data Protection

Personal data collected during the order process is necessary for the management of the transaction and the provision of services. It is processed in accordance with our Privacy Policy, in compliance with the General Data Protection Regulation (GDPR).

The Client may, at any time, access, modify, rectify, or delete their data by contacting The All American Shades at contact@theallamericanshades.com.

10. Intellectual Property

All elements of the Site (texts, images, graphics, logos, videos, etc.) are protected by copyright and remain the exclusive property of The All American Shades. Any reproduction, modification, or unauthorized use of the elements of the Site is prohibited without prior agreement from The All American Shades.

11. Governing Law and Jurisdiction

These Terms are governed by French law. In the event of a dispute, the Client is invited to contact customer service to attempt to find an amicable solution. If no solution is found, only French courts will have jurisdiction.
